FDo Not Retain Philip J. Walsh, Esquire for plaintiff tort representation

Approximately six years ago, our family retained this attorney to represent us as plaintiffs in a private nuisance lawsuit that had already prevailed before the Supreme Court of Virginia 'pendent lite' had already overturned the Virginia Circuit Court's denial of injunctive relief to remove a noxious... private nuisance (oversized aggressive growing tree that stood 120' feet high, 5' diameter trunk and invasive root and branch systems) that was destroying our home which was located next door to a tortfeasor neighbor who refused to remove the tree and its resulting root and branch systems that destroyed our home's entire value. Philip Walsh committed legal malpractice and we received inadequate legal representation even though our family prepaid all attorney fees, expert fees and trial fees up front before trial. The family not Walsh retained, prepaid and prepared seven expert witnesses in engineering, soil science, arbors (tree scientists), governmental regulation or lack thereof and etc. that made this case foreseeably a slam dunk for a substantive settlement and/or successful trial outcome that required removal of the tree and imposition of damages against the Tortfeasor Defendant neighbor. Mr. Walsh compromised our case with the insurance defense firm and with the insurer and his conflicts of interest in this case and compromising of our trial strategy, tactics, designated witnesses, violations of attorney-client privilege, violations of attorney work-product all without consent by us and in direct contravention of our express intentions and commands to Walsh made our case a disaster. We lost our home and all of our savings due to Walsh's legal malpractice in handling our case. Then after the case was lost and we lost everything and were in bankruptcy, Walsh sued us for padded false attorney fees that the US Bankruptcy Judge and the US Trustee both decided were "not appropriate" and "not verified" by Walsh's records. Accordingly after the 341 Meeting of Creditors, Walsh's claims of debt against us were dismissed by the Federal Bankruptcy Court.
