Chambers v. North Carolina Department of Justice, et al.
Apr 17, 2023OUTCOME: Vacated in part and remanded for further proceedings in district court.
District court dismissed entirety of complaint for wrongful termination based on race as time barred. Court of Appeals for the Fourth Circuit determined that the district failed to apply the correct st ... atute of limitations to the claims brought under 42 U.S.C. § 1981, so the Court vacated in part and remanded for further proceedings. This case established that the proper statute of limitations for an action brought for wrongful termination (which is based on post-contract formation) under 42 U.S.C. §1981 is four years, not three years, even for state actors sued under the procedural vehicle of 42 U.S.C. § 1983.
