The People's subsequent modification of the Appellant's guilty plea to include a restitution order in the excess of $128,000.00 constituted such a drastic change in circumstances, that the terms of the ... original plea bargain was invalidated. Consequently, the Appellant was allowed the option to withdraw her plea, motion the court of a hearing on restitution and ability to pay such restitution, or do nothing and let the plea stand as modified.

OUTCOME: (2018) Reversed - Defendant's Motion to withdraw guilty Plea Granted.

At a morning arraignment hearing, Appellant plead guilty to a misdemeanor violation of the Penal Code without consulting counsel or the assistance of the Orange County Public Defender. After the no ... on hour lunch break, Appellant again appeared before the court and sought to have her guilty plea withdrawn. The court assigned the Orange County Public Defender to represent the Appellant and set the matter for a hearing on the Appellant's soon to be filed Section 1018 Motion which was later denied. Appellant through counsel appealed the denial of the Motion and conflict counsel was appointed. On, or about May 9, 2018, after Briefing and Oral Argument on the matter, the Appellate Panel revered the trial court's denial for the Appellant's motion to withdraw her plea and the case was remanded back down to the trial court for further proceedings.
