I was ask to mediate a case that was in active litigation. Both sides had spent over $50,000 in legal fees. The attorneys told me it was hopeless, but needed to "go to Mediation" to get a trial date. ... The parties hadn't spoken directly for over a year. They had teenage children, debt, mortgages, assets, and a lot of unresolved marital issues. The court system was not working for them. The point is simple: consult with a mediator (with or without an attorney) and make sure you are in control of your situation.
