I am not sure who Mary is? I have not represented a Mary. I would like to speak with her how I can resolve the issues. In the initial hearing, some jurisdictions do not have them like Washington County. However, Frederick County do have them. Essentially, an initial hearing is to get dates for either for settlement such as mediation and/or settlement conference or a Trial. It is not for the purpose to conduct a trial. Normally, it is quick and if there are any special issues that need to be announced to the court that is very important such as Abuse and Neglect of a child by the other parent or something like if a parent is involved with a drugs, alcohol, criminal activities, or abuse by the other parent. Magistrate conduct the hearings and do not have any power to Order parties to act. However, Magistrate can make recommendations to the Judge where a Judge approves the recommendations wherein it becomes an Order. In essence, a Judge can make the Order. To get a court date, takes anywhere from 8 months to a year depending the Court's schedule. Essentially, in the initial hearing, Magistrate would like to know what the issues such as access or custody and move on with the dates. For family law cases, I work on a hourly basis. If the retainer is depleted and not replenished and an outstanding balance accrue, then I can strike my appearance. There is no case at the initial hearing, so there is nothing to win. I am not sure what she is bringing up. I am not sure why she had said those things about me, but I am willing to speak with her to try to resolve any issues she has with me. I am willing to listen and talk about her case. I am not sure why made such as a negative comment about me. I am willing to work with people. Once again, dealing with Family cases it is a long drawn at matter and requires a lot of time. Depending on the parties, it can take several months to settle or have a hearing done.
