OUTCOME: My client, CIGNA, was succesful

CIGNA was sued under an ERISA theory that sought to hold health plans liable for benefit decisions as medical malpractice decisions. I argued and briefed the case at the trial court level and won with ... the court dismissing the Plaintiff's claim and holding that benefit decisions are not healthcare decisions. Plaintiff appealed to the 5th Circuit where my trial court brief became the appellate brief. The case was later appealed to the US Supreme Court where my briefing was successfully argued before the Court. This case attracted nationwide media and legal coverage.
