The Texas Supreme court ruled as I had argued that t ... he injury at the hospital occurred 2 years and 2 days before suit was filed, thus it was barred by the 2 year statute of limitations. Although the child's cause of action was extended because he was not an adult, the parent should have filed within 2 years of the injury, not 2 years from the date of death.
