My client operated a medical clinic beneath a dental office. My client experienced over 5 leaks into her offices, and was forced to shut down for hours at a time while the water damage was repaired. ... The dentist claimed he was not negligent, and therefore not liable for the damage. We showed that the condo. documents required that an upstairs tenant was responsible for water damage to a lower unit, and argued that he was liable under a negligence theory because he did not repair his property promptly after my client reported the damage to him. We obtained a judgment for $25,000, which was the cost of the repairs.
