It depends how the language describes the late fee. It should be five percent of total rent owed. If the entire rent is not paid then it is late....

If you evicted him then he is out. If you only have the warrant of restitution you need to set the eviction date with sheriffs.

If your lease is e ding then yes the landlord can change the terms. If your mid lease then no you can decline.
