If they gave you proper notice then yes. You can not renew your lease.
If it was not filed then the landlord did not lose the 40 in filing fees therefore you can dispute the charge.
You have to have an attorney look at the lease. However tenants have great protections when the unit is uninhabitable.
Hire an attorney to discuss options. If you do not have a record then an attorney can probably get you diversion.
