NY Law vs NJ Law. I am aware of a local rule in NY, Rule 9023 for re-argument. This is a bankruptcy rule I believe.

The Bankruptcy Rules apply only in bankruptcy cases. Rule 9023 is a national rule that applies in all bankruptcy courts in the country.

While your refund cannot be garnished, once it has been deposited into your bank account, it can be attached.

It depends. Most credit card agreements contain an "Application of Laws" clause, specifying which state's laws apply.
