If you have a written settlement agreement, the mere fact that there is a new lawyer doesn't mean that he gets to change the terms.

Even if you are named Personal Representative (what Maryland calls the executor of the estate) in the will, you do not have to accept the appointment.

Yes, you can file a motion. I would under no circumstances do this without hiring an experienced Chapter 11 attorney.

No. it is not too late. So long as the change is made before you become entitled to any distribution, your case should be unaffected.
