N/AOUTCOME: Pedestrian case settled 2 days before trial.
My client was seen darting into West Street in Annapolis MD. I investigated this case to see how the facts might show that the driver was negligent. In Maryland 1% fault by my client acts as a complete ... bar to his recovery. We found evidence that Mr. Spencer had the right of way, as he was in an "unpainted crosswalk." The witness was questioned about his poor view of the occurrence from half a block away. This case settled for $50,000.00 on the eve of trial, June 5, 2009.
