People v. Jack Noriega: Fresno County Superior Court case number 0676057-3

OUTCOME: Jury convicted on all counts. The trial court stayed a 7 year prison term and placed Mr. Noriega on probation.

The District Attorney charged Mr. Noriega with using a semi-automatic handgun to shoot at his wife while she was in their truck. (Penal Code sections 245, subdivision (b), 12022.5, 246, and section 120 ... 31, subd. (a)(1).) While negotiating with prosecuting counsel, we spent a year exploring intoxication and mental state issues. Our best offer from the DA's office was 10 years, and our best indicated sentence from the court was 7 years.

OUTCOME: The jury acquitted Mr. Luna on each count and all of the various alleged lesser included offenses. I subsequently filed a civil suit against the owner of the premises and against the two alleged victims. The civil action settled without trial.

The District Attorney charged Mr. Luna with two counts of violations of section 245, subdivision (a)(1), assault with a deadly weapon, a screwdriver, on two victims, during a party at a motorcycle deal ... ership. The defense claimed that one of the alleged assaults had not taken place at all, and that Mr. Luna was acting in self-defense as to the other.

OUTCOME: The jury acquited Mr. Trujillo on the 211 count, thereby eliminating the 20-year enhancement for discharging a firearm during a robbery. The jury convicted on the two counts of Penal Code section 246 (shooting at an occupied motor vehicle).

The District Attorney charged Mr. Trujillo with a count of robbery (211) including a personal use of a firearm enhancement (12022.53), and two counts of shooting at an occupied motor vehicle (246). Mr. ... Trujillo was at a pay phone waiting for a return call, when a young man (a police cadet) approached and demanded to be allowed to use the telephone. The young man said that Mr. Trujillo then stuck a pistol under his chin and stole his gold necklace. The cadet alleged that Mr. Trujillo fled in a car and that he gave chase. During the chase Mr. Trujillo was alleged to have fired his gun at the cadet's' car.

OUTCOME: The court declared a mistrial after the jury hung 8-4 for acquittal. Prior to retrial, defendant entered a conditional plea to a sexual battery. He successfully completed his conditional settlement period and the court dismissed the case.

Mr. Aroni was charged with a violation of Penal Code section 261, subdivision (a)(2) case, forcible rape.
