Lawsuit results from a collision that occurred on July 7, 2010, in Upshur County, Texas. Mrs. Ballard was lawfully stopped in her proper lane of travel with her left turn signal activated and yielding ... to oncoming traffic in an effort to make a left turn when she was violently struck from behind by Defendant driver who was driving a commercial water truck owned by his employer, Integrated Water Recovery Systems. The collision was proximately caused by the negligence of Defendant driver. Mrs. Ballard sustained multiple/generalized soft tissue trauma in this violent collision, her most serious and chronic injuries included a herniated disc at C4-5, a disc protrusion at L5-S1, facet arthropathy at L4-5 and L5-S1, including an annular tear and an internally disrupted disc at the L5-S1 level.
