OUTCOME: Clearance granted.
Client was denied security clearance based on being fired from a job. The reason for being fired was that he accessed the IT systems in an unauthorized manner. Client went with me to a hearing before ... a DOHA judge.
OUTCOME: No misconduct, retention
O-3 (with 28 years of service) client found "guilty" at Art. 15 for DWI at an overseas base. At the Board hearing we were able to provide testimony of an expert who was able to show, using a retrograd ... e extrapolation of the .BAC, that the client could not of had 8 drinks in two hours, etc. Board members found NO misconduct and of course recommended retention.
OUTCOME: Retired in grade
Accused of threatening emails and stalking, as well as orders violations. After presentation of case received a nonpunitive letter of caution, along with favorable endorsement of retirement request.
OUTCOME: General Court-Martial charges dismissed, summary court-martial on unrelated charges.
Accused of rape. After a pretrial motions session and interviews in preparation for trial, the complaining witnesses (husband and wife) decided to "tell the truth." The allegation of rape was false. ... There were other unrelated charges which were disposed of at a summary court-martial with a board waiver.
OUTCOME: Mixed findings, good sentence
Granted new trial after conviction of BAH fraud in amount of $132K, and sentence of BCD and six months set aside. On retrial mixed findings, with attempted theft of over $500.00. Reduced in rank one ... pay grade and forfeiture of $1000.00 per month for two months. Retirement papers submitted.
