Talk to the recruiter.
Be honest.
Keep in mind that the military is in a drawdown. People are not getting waivers and they are being more picky...

Check the court rules, for the specific court your appeal is in.
You also might be able to get more time.

Prosecutors can't vouch for witnesses.
The other issue is the "golden rule" argument which is not permitted -- to put themselves in a victims shoes.
