OUTCOME: Jury Verdict NOT Guilty kidnapping for ransom and Not Guilty torture.

Client was charged with Kidnapping for ransom and torture. Both carried Life-Without Parole. DA would not give us any offer. Cops found Client was in a car with co-defendants and the alleged kidnap ... ped victim hog-tied and beat up in the rear cargo area. Cops tracked the car down after tracing the ransom calls from it. We knew it was going to be a tough case, that's why we were begging for any "non-life" offer. The DA would not budge. We had to go to jury trial.

OUTCOME: Motion to Supress Granted Case Dismissed

DUI case. Cops pulled client over after claiming that my client's truck swayed two feet over the double yellow. We demanded the police car video camera surveillance. It appeared from the video that ... our client's tired barley touched the double yellow line. (less than one inch). We filed a motion to suppress per PC 1538.5. At the hearing we showed the judge, and he agreed with us. Cops were lying, they did not have any legal reason to make the stop on my client. Case dismissed. Just another example why NO ONE should ever just go and plead guilty to a DUI until you have a quality attorney go through it with a fine tooth comb.

OUTCOME: Not Guilty on all counts, on all theories.

Murder Case, with Gang Enhancements. Client was 18 yrs old with no real criminal record. At 300 am my client was in the backseat of car that was being driving by his co-defendant. He was merely ge ... tting a ride home. The co-defendant was a tattooed up real deal gang member that was in an ongoing war with another rival gang. During the drive home ,the co-defendant saw some potential members of this rival gang, THe co-defendant stopped the car, and along with my client they got out of the car to confront these other young men. A fight began between both groups, and one young man in the rival group was stabbed and died on scene. The surviving victims of the rival gang said my guy did the stabbing. DA was not really sure who did the stabbing. It did not matter to the DA who did what because in their minds both are equally guilty under the aider and abetter theory. Any person who knowingly engages in gang activity (gang fist-fight for example) is responsible for all the criminal conduct committed- that would be "foreseeable". Whether someone is the stabber or the aider and abetter makes no difference since both are equally guilty under the law (25 years to life minimum sentence). Both the DA and the attorney for the co-defendant argued that my guy was the stabber. We had to not only show that my guy was not the stabber, but that he also had no idea that this was a gang fight to avoid a guilty verdict on the aider theory. Trial was five weeks long. Result: Not Guilty on all counts, on all theories. My now 20 year old client was released the same day.
