OUTCOME: Not Guilty of Driving While Impaired

Driver charged with DWI after accidentally bumping the car in front of her in a car wash. The driver had her child in the rear seat. She refused the breath test out of fear of a false positive result. ... Had she been convicted she would have served at 32 month active sentence and she would have missed the first three years of her baby's life. Through cross examination of the state's witness and of the Officer, I was able to point out irreconcilable differences in testimony, all of which lead to a reasonable doubt as to whether the driver was impaired.

Driver was pulled over for nearly hitting an officer who was standing in the middle of the road in an unlit area. This was treated as a felony traffic stop and she was ordered out of the car at gun poi ... nt. After handcuffing her and discovering she had a prior conviction for impaired driving, the officer decided to charge her with impaired driving again. There were no Standardized Field Sobriety Tests performed.
