N/AOUTCOME: Not Guilty of Driving While Impaired
Driver charged with DWI after accidentally bumping the car in front of her in a car wash. The driver had her child in the rear seat. She refused the breath test out of fear of a false positive result. ... Had she been convicted she would have served at 32 month active sentence and she would have missed the first three years of her baby's life. Through cross examination of the state's witness and of the Officer, I was able to point out irreconcilable differences in testimony, all of which lead to a reasonable doubt as to whether the driver was impaired.
