OUTCOME: NOT GUILTY JURY VERDICT ON ALL 15 FELONY COUNTS!!

JW, a divorced mother of two teens, was accused of having a 4 year clandestine sexual affair with a minor from who was between ages of 13 to 17 at the time. There were 15 felony counts ranging from lew ... d acts with a minor, to statutory rape and sodomy, with special allegations that made her probation ineligible despite no prior criminal record. The hundreds of sexual acts were alleged to have occurred in nearly every room at her house, her car, her offices and motels. The evidence included text messages and recorded snapchats between them, as well as DNA and physical evidence the prosecution argued proved the crimes. She testified that he raped her and made up his story to cover up his sexual assault against her. After a roughly 5 week jury trial and over a week of jury deliberations, she was acquitted on all counts!

OUTCOME: NOT GUILTY!!

After a party, intoxicated female fell asleep in client's bed wearing only a T-shirt. Later, client went to bed and was discovered there with the female who claimed client forcibly raped her and forced ... her to orally copulate him. She fled on foot to her own home nearby and told her mother she had been raped by client. She was taken to the hospital for a sexual assault exam, and interviewed by law enforcement. After a full investigation, client charged with felony forcible rape and felony forcible oral copulation. Three week trial.

OUTCOME: Misdemeanor, community service, probation terminated early

SB, a college student, was driving home early one morning when she fell asleep behind the wheel of the car she was driving. The car veered off the road and struck and killed a woman who was standing on ... the sidewalk. SB woke up with her car coming to rest in a nearby parking lot. Not knowing that she had struck the unfortunate woman, she proceeded home to her apartment nearby. When she arrived home she heard sirens and wondered if she may have been involved in an accident. Observing some minor damage to the front of her car, she returned to the scene where she saw what had happened. She voluntarily surrendered herself to police who questioned and released her. After a lengthy investigation, the case was negotiated before charges were filed. She was convicted of a misdemeanor only, with community service as a condition of probation, which she performed so admirably that the judge terminated probation after only one year. The vehicle, which had only very minor damage, was donated to a charitable organization.

OUTCOME: Case reversed on appeal and dismissed!

In the course of a major federal gang and drug investigation where numerous warrants had been obtained to monitor phone conversations of dozens of unsuspecting suspects, officers intercept part of a p ... hone conversation they believe to be related to drug sales. They obtain a warrant to search JO’s residence, where they find a handgun and some ammunition. Being an ex-felon and a “three striker,” JO faced 25 years to life for possession of a firearm. (The firearm was actually his teenage son’s of which he had no knowledge). A motion to traverse/quash/suppress the warrant was litigated over several days, the trial judge ruling against JO in support of the warrant. The ruling was appealed and the appellate court sided with JO saying that the warrant was defective and lacked probable cause, sending the case back to the trial court where the judge granted his motion, suppressed the evidence against him, and dismissed the case.

OUTCOME: Felon in Possession of Firearm Dismissed!

AM, who was on probation for a “strike” offense, was stopped while driving his vehicle for an extended trip to visit family, which, the officer claimed, had unlawfully tinted windows. Discovering that ... AM was on probation and open to search and seizure, the officer searched his car. Finding nothing illegal, he decided to search AM’s cell phone. On ordering AM to give him his pass code, the office discovered a photograph of AM holding a handgun. Believing that the photo was recent, he called other officers to assist by going to AM’s residence and searching it. His wife was home, and unbeknownst to AM, had just placed a handgun of her own under the mattress, which she retrieved from her parents after AM left, for protection while he was out of town. Finding the firearm (not the same one as in the cell phone photograph), AM was arrested for being a felon in possession of a firearm while he still remained at the scene of the vehicle stop. After refusing to settle the “three strikes” case prior to the filing of the motion, a lengthy motion to suppress hearing was conducted over several days, at which the prosecutor dismissed the case prior to the court’s ruling on the motion.

OUTCOME: Double murder conviction reversed, case dismissed

17 year old boy convicted by a jury of murdering a young pregnant girl during a robbery of a convenience store, While serving 2 life terms for a crime he didn't commit, his conviction was overturned on ... a habeas petition by the Innocence Project of Northern California. I was appointed by the Fresno County Superior Court to represent him for retrial - I did not represent him in his previous trial. After investigation and preparation for retrial, I was able to convince the prosecution that Armando was at another place at the time of the murder, and the case was dismissed on eve of the second trial.

A fight begins inside a loca bar where young Daniel was working as a DJ. It continues outside as the bar closes and as Daniel is getting off work a man is stabbed and dies in the parking lot. On invest ... igation, police say several witnesses said Daniel was involved in the fight, and stabbed the victim. At trial, the witnesses deny telling this story to police, and testify that Daniel was not involved in the fight. The weeks-long trial results in the jury acquitting Daniel of murder.
