Two adverse parties had a substantial (and very confidential) dispute over appropriate legal fees for the handling of a high-profile civil rights matter. Since I had done work for each of the parties ... and their lawyers in past years I suggested that perhaps they could both appoint me to prepare a binding report and thus avoid the expense of each side retaining its own team and incurring litigation costs. They agreed to do this. I prepared a binding report--attempting to be as fair and reasonable as possible, but my conclusions as set out in a lengthy report were very favorable to one side. Notwithstanding this "lop-sided" result EACH of the sides have subsequently retained me in other matters.
