Refugee Seeks Waiver of Grounds of Excludability
Jul 05, 2011OUTCOME: Waiver granted
Client was a persecuted political activist in his country of origin and has been a refugee in the US for many years. One day he unwittingly finds himself caught in a contraband scheme that results in ... a felony conviction (3-mo jail sentence and a 3-year probation sentence, later lowered to 1 year). He faces removal (deportation) from the US, as the USCIS, considers the charge and conviction equal to a Crime of Moral Turpitude (CMT). Client is the sole provider of 4 children and their mother. Going back to their country of origin is deathly dangerous for himself and wife. Client applies for a Waiver of Grounds of Excludability.
