OUTCOME: Same client (KS) - We'll get him now...or not...

Same client in previous DUI trial, same county, same courtroom, same judge, different charge this time - public drunk. Normally a slam dunk easy case for the prosecution, and they certainly had the "W ... e've got him now - He's definitely going to jail" mentality. Set the case for trial, put 6 in the box, and shocked the judge for a second time as it only took the jury 35 minutes this time to come back with a not guilty. Who knows maybe we'll make it 3 for 3.

OUTCOME: DUI Refusal with 35 minute bad video = Not guilty

17 motions of various nature denied by judge on day of trial, all evidence comes in including a video tape showing my client berating the trooper with incredibly creative cuss words and bad field sobri ... ety tests. Following my cross of the trooper regrading his field tests I asked him to turn to the jury and tell them just how much faith they should put in his decision to arrest my client based on the field tests - his answer 'none'. Took the jury just over an hour to return with a not guilty verdict.
