OUTCOME: All breath test affidavits for the state declared invalid
argued that the required affidavit was facially invalid. Court agreed and all test using that affidavit will be invalid became DPS had no jurisdiction.

State wanted 30 years in prison for a mother of 2 boys who had no prior criminal record. Jury heard testimony of clients blood test showing marajuana and zanex in her system. She hit a man in a wheelch ... air and he died. I convinced the jury that my client was not the direct cause of the accident and they said NOT GUILTY!
OUTCOME: Case Dismissed
A very unique path to a win at the Appellate level. Client was charged with Trafficking in Illegal Drugs, Possession with Intent, Failure to Obtain Tax stamp and various other charges. At the Preli ... minary Hearing a motion to suppress I filed was heard and granted. The state filed a Rule 7 appeal to the District Judge who set it for hearing and eventually granted the State’s motion, overturned the suppression and remanded the case to the Preliminary Hearing. At the second Preliminary Hearing we were bound over to the District Judge where we filed a new motion to suppress which was overruled. Then I filed a motion to reconsider. At the motion to reconsider the judge granted my suppression motion and dismissed the case. The State promptly appealed to the Court of Criminal Appeals. The CCA reviewed the case and upheld the District Courts ruling and dismissed the case in full. Client went home happy and the rule of law was upheld.
OUTCOME: Not Guilty
Client was charged with First Degree Manslaughter following the death of two people. She had blood drawn and tested at .21, almost 3 times the legal limit. The punishment range was up to life. I was su ... ccessful in suppressing the blood results and the case was tried to a jury where we got a not guilty on both manslaughter counts. My client went home that evening.
