A client came in with a terminal illness and stated that they wanted to disinherit their child from their estate. The fear was that if the child received a large settlement, they would continue their o ... pioid use and harm themselves further. The client was very conflicted because they did not want to abandon the child but could not rely on the child correcting their behavior. We drafted a Special needs trust that required certain behavior from the child in order to benefit from the estate. The client was happy because there was a safety net installed that allowed for assistance for the child but also protected the child by not enabling them with an estate settlement.
