Client established a sole benefit trust for the benefit of her niece. MassHealth denied long-term care benefits to the aunt, claiming the trust was countable.
OUTCOME: Very satisfied clients with properly structured and funded Revocable Living Trust
A married couple (names changed for privacy) with two minor children sought to: (1) avoid probate; (2) protect their assets from estate taxes; (3) provide for proper end-of-life health care and financi ... al management; and (4) ensure proper asset management for the children by a trusted family member in the event of their untimely deaths. With new Wills, Revocable Living Trust (funded with current assets), Durable Powers of Attorney, Health Care Proxies and Living Wills, clients were able to meet their goals within two weeks of our initial meeting.
OUTCOME: We established a Medicaid Asset Protection Trust to protect her house/assets from Medicaid if she ends up in a nursing home. Also, the trust will protect her son's inheritance from all creditors. Bottom line: we SOLVED HER PROBLEMS.
A divorced 70-year old wanted to ensure her two children would inherit her house and assets upon her death.
