Client indicted in United States District Court for possession of cocaine with intent to distribute. During the trial, the prosecutor made comments to the jury concerning the Client's right to remain ... silent which violated the Client's 5th Amendment rights. Following the entry of a verdict a motion for new trial was filed on behalf of the client.
OUTCOME: Sentence vacated and case remanded for proper sentencing.
Following sentencing, the Federal District Court Judge failed to elicit objections from the Defense as to the sentence imposed.

Client purchased a home at a foreclosure sale. After the deed to secure debt was paid in full, there were surplus proceeds. The original owners of the home objected to the use of the surplus proceeds ... to pay the outstanding and delinquent ad valorem taxes on the property, and claimed that the Client should have to pay the taxes so they could recive all surplus funds. The trial court disagreed, and found that the taxes should be paid from the surplus proceeds, as opposed to our Client. The original onwers appealed.
