We represented family in a successful appeal of a guardianship case, which resulted in an appellate decision that changed Illinois precedent on guardianship law. Synopsis from legal bulletin: Mothe ... r who, with father, had relinquished their parental rights in favor of child's adoption by paternal grandmother petitioned for emergency and temporary guardianship after adoptive grandmother's death. The Circuit Court, Tazewell County, Michael D. Risinger, J., granted mother plenary guardianship and subsequently denied motion to vacate filed by relatives of child's father. Relatives appealed. Holdings: The Appellate Court, McDade, P.J., held that: 1 petition was evasive, duplicitous, and statutorily noncompliant, and 2 mother was required to give notice of hearing to father and relatives.
