Motion to Quash / Motion to Supress Granted
Mar 01, 2016OUTCOME: Dismissal of All Charges
A Client was charged with Felony driving on Suspended Charges, with several other traffic tickets. The Client was offered 1 year of Department of Corrections, based on his background, after a 402 Conf ... erence The case had been through the public defender, as well a couple attorneys. I noted that we never received the Video of the Stop, and the Officer's testimony in the Preliminary hearing sounded questionable. I filed several motions, and we had a hearing which lasted several hours over the morning and evening. I challenged the reason for the stop, and asked officer's about the ticket they wrote, and proved that he was not sure about the sufficiency of the ticket. I also questioned two Officers about the way their car is able to record video and their department procedures. Needless to say, the Judge, found my arguments persuasive and granted the Motion to Quash Arrest and Suppress Evidence, and all charges were dismissed. My Client was free to leave and was more than satisfied.
