Surprise 1997 deportation!
Jun 01, 2017OUTCOME: Extremely hopeful!
My client applied for a green card based on his marriage to a U.S. citizen. At the interview, it came out that he had been deported in 1997. This was a surprise to us all. The process he remembered did ... not seem at all like a deportation. Plus, we had thoroughly researched his background and there was no evidence of a deportation. We were lucky that his green card interview happened before many of the harsh policies of 2017 came into effect. We also worked hard and fast to gather over 200 pages of support letters, doctor letters, financial records, and other documentation of the hardship his family would suffer if he were deported again. We succeeded in convincing the immigration service to give him a chance to fight his case in immigration court. It will be at least another year before we get a decision, but he has a very good chance now of staying in the United States.
