The jury found Plaintiff’s medical complaints and expenses related to a genetic condition as opposed to the auto collision. Plaintiff sought over $1M in damages at trial. $16K Judgment was below the Statutory Offer of Settlement.
OUTCOME: Settled at mediation following two trials where the juries were "hung" and unwilling to award Plaintiff's claimed damages.
This case was re-tried following a "hung jury" refusing to award Plaintiff any damages related to his disputed injury claims following a motor vehicle collision. The second trial was held in September ... and resulted in the jury splitting on the compensable value of Plaintiff's damages. After the second hung jury, we requested Court Ordered Mediation where the case was resolved for $10,000 less than the previous "highest offer" by the defense. This was a tremendous victory for the defense!
OUTCOME: After two-days of deliberations, the jury was unable to reach a verdict. Many jurors wanted to award $0 in damages to Plaintiff while one wanted to award up to $25,000. The case is scheduled to be re-tried in August 2015.

Plaintiff alleged that he was unable to stop and collide ... d with Defendant's vehicle. Defendant admitted negligence but argued Plaintiff's injuries, damages, and losses were not related to the auto accident but predated the accident. Furhter that the alleged medical and dental treatment was not reasonable, necessary or related to the accident. Defendant admitted liability and confessed damages for a portion of the medical bills totalling $9,100 plus non-economic damages up to a maximum of $10,000.00.

This very serious single car roll-over accident resulted in substantial injuries and damages well in excess of the liability coverage available to the injured parties. We filed an Interpleader action ... to limit the exposure to our clients, SHR and their driver, to the proceeds of the insurance policy. In addition to resolving all civil claims against both clients, we were able to utilize the settlement negotiations to address lingering issues in the criminal aspects of the driver's case and secure a release of Restitution Order related to alleged violations of the traffic code.

OUTCOME: A Directed Verdict was awarded to the Defense at the close of Plaintiff's case. Defense was awarded over $10,000 in costs.

Plaint ... iff alleged that the lack of a working light in the carport was a "dangerous condition" that led to her injuries. Defendant succeeded in arguing that Plaintiff was a "social guest" of a tenenat at the residence and that there was no liability for the alleged injury.
OUTCOME: Jury Verdict for the Defense. The jury agreed that Plaintiff engaged in "road rage" and determined that Plaintiff was the sole and proximate cause of the motor vehicle collision. The defense was awarded nearly $17,000 in costs.
