Mr. Temple is a disabled veteran who was charged with OVI Impaired in May of 2011, when an overzealous trooper ran his license plate for no apparant reason which came back "plate not found." However, ... Mr. Temple just purchased the car that day, he admitted to drinking hours earlier in the afternoon and that he had taken his prescription medication (vicodin) as prescribed for pain. At times, he used a cane to walk because of his leg and spine injuries. By the time the case was to proceed to trial, he was permanatly paralyzed in the VA. Yet, the State of Ohio wanted to proceed to conviction. His breath test was a .04 BAC, under the legal limit. His blood test came back negative for vicodin, however, his urine test came back positive. The trooper even checked to see that he had a valid prescription.
