Hebert v. City of Fifty Lakes
Jul 13, 2010OUTCOME: The Minnesota Court of Appeals held in our favor, stating in a published opinion that statutory and common law dedication operated in the same way as adverse possession and therefore did not apply to Torrens property.
Scott Lucas and I represented a group of neighbors in a lawsuit against the City of Fifty Lakes. The City built a road that encroached on our clients' private property. The City was attempting to cla ... im ownership of the property via statutory and/or common law dedication. We argued that the City could not take the land by dedication because the property was registered Torrens, and Torrens property is protected against adverse possession claims under Minn. Stat. 508.02.
