In order for the decision to be changed you will have to show how the late filing was caused by events out of your control.

It can take just a few days to a few weeks. ICE must notify the Brazilin consulate first. The consulate can help speed things along.

Yes you can simply withdraw the petition without any reason However, it may be best to point out that he is now a permanent resident.

It can be a few weeks to a few months. Yes you can call the NVC or the consulate to make inquiries.
