Affidavits do not really help unless there is other proof of the marriage such as joint bank accounts, both names on leases, beneficiary of life...

Adopting your nephew will not help his situation because he is already too old. The adoption must occur when the person is under 16.

You cannot work without the new card being approved. Keep making the requests to USCIS or hire a lawyer to help.
