Defendant was charged with attempted spousal rape, forcible penetration with a foreign object, domestic violence, assault with intent to commit rape, child abuse, criminal threats, false imprisonment, ... destruction of a telephone and witness intimidation. The maximum prison exposure was over 30 years! After three weeks of trial and a vigorous defense, the jury agreed that the motive behind this mid-divorce incident was an attempt by the "victim" to put the defendant behind bars to obtain full custody of their children. The jury found that the defendant properly defended himself from his wife who had just hit him in the head with a telephone as his 7 year old son was walking into the room. A happy ending......the defendant who was suspended from his job for over a year while the case was pending is back at work and sees his children on a regular basis.
