The minor plaintiff, a 10 year old female, was present in her home when the police appeared to execute a search warrant on her father. Without having any probable against his young daughter, the polic ... e conducted a strip search on her and her mother. Suit was filed against various police officers in the Middle District of Pennsylvania alleging Federal Civil Rights violations. After discovery, the parties filed Motions for Summary Judgment. The Federal Judge found in favor of plaintiffs and determined that the minor plaintiff and her mother' civil rights against unreasonable searches had been violated. A trial was schedule on damages only and the case settled prior to trial. the case was appealed to the Third Circuit Court of Appeals and the panel of judges included Michael Chertoff (former head of Homeland Security and Samuel Alito (now a U.S. Supreme Justice). The Third Circuit affirmed the lower court's decision. thereafter, the defendants requested that the US Supreme Court here the case, but that appeal was denied.
