OUTCOME: Not Guilty

A case of swerving to avoid both a deer and potholes, that led to a stop, arrest, and .15 BAC result on the DataMaster DMT. Even with two of the top five certified DataMaster Representatives in the st ... ate testifying on behalf of the prosecution, the jury refused to believe a number on sheer faith. The first trial ended with a hung jury. Still the prosecution pressed on. I was able to secure a reasonable plea offer, but my client refused to compromise his values. Instead, the jury rewarded his faith in justice by acquitting him and allowing him to return to his life with no criminal conviction.

Reckless on the Day of Trial

OUTCOME: Plea to Reckless, with no jail

Client was sleeping in her car outside of a drugstore, when police were called to the scene. Even without witnessing any driving, they proceeded to order her out of her car. She was forced to take te ... sts and was ultimately arrested. The breath test showed a .11 and a .11 BAC. Because of a prior offense, the prosecution refused to offer a non-alcohol plea offer and we set for trial. On that day, they finally relented and allowed a plea to Reckless Driving, which my client gladly accepted.

2nd Offense to Reckless

OUTCOME: Plea to Reckless, with no jail

Client was stopped for a 2nd Offense. Even though his blood was a .084, his prior was only a year before, which prevented the prosecutor from giving us a non-alcohol offense. After repeated attempts ... to resolve this with the prosecutor, we set the matter for trial. On the day of trial, the prosecutor was forced to admit that they were not prepared to proceed. They offered, and we accepted, a non-alcohol offense. However, that still meant he faced possible jail time before a Grand Rapids Judge. Throughout our case, my client did everything I could tell him in the way of counseling and it carried the day. No jail and no drunk driving.
