The Ohio Attorney General’s Special Prosecution section charged an Ohio doctor with operating a pill mill. The indictment included over 100 predicate acts, including drug trafficking, RICO (engaging in ... a pattern of corrupt activity), and conspiracy charges arising from the operation of an Ohio pain management clinic. The prosecution alleged that the doctor was writing prescription pain pills (oxycodone, hydrocodone, fentanyl) without a legitimate medical purpose and was allowing his staff to write prescriptions unsupervised. The indictment included over 100 patient interactions involving a significant number of patients. Nurse Charged With Health Care Fraud, Drug Possession & Unlawful Prescribing Has Charges Resolved and Continues to Practice

OUTCOME: After successful completion of the MCL 333.7411 program, the nurse will have no criminal conviction on her record. The nurse was able to maintain employment through this process and her nursing license was never suspended.

Nurse was charged with obtaining drugs by fraud, health care fraud, identity theft, and possession of narcotics for prescribing drugs to herself amounting to thousands of units of hydrocodone and other ... narcotics. A criminal conviction would have resulted in her incarceration for up to five (5) years and loss of her nursing license. With overwhelming evidence in the case against us, the goal remained to get the best deal for the nurse as possible. Through a series of tough negotiations with the Prosecutor and by portraying a strong defensive position we were successful in dismissing four of the five (5) counts and obtaining diversion pursuant to MCL 333.7411. MCL 333.7411 permits a person who plead guilty to possession or use of a controlled substance to complete probation and once probation is completed the court will dismiss the charge with no resulting criminal conviction. This means that our client can continue to practice as a nurse and will not be excluded from billing Medicare/Medicaid.

We were retained to represent the client during the investigation and any subsequent administrative proceedings. We immediately obtained the relevant medicine/medical administration records (MAR) and t ... reatment records for the patients in question. Using their experience and in-depth knowledge of medical records, we were able to audit the relevant records in order to link the administration of medication and wasting procedures in order to show that the narcotics in question were administered or wasted. During the investigation we were able to prove to the investigator that the allegations of diversion were false and the board promptly dropped the investigation.
