A few months later, the Employee hired me and I filed a hearing request seeking recommencement of her income benefits. After discovery, we went to trial, and I proved to the Judge that the suspension of her income benefits was both procedurally invalid and substantively improper, and that the Employer/Self-Insurer was unreasonable in defending the case. Ultimately, I was able to get the Employee's income benefits recommenced and paid back to the date of suspension, with penalties, and it didn't cost her a penny as the Judge ordered the Employer/Self-Insurer to pay all litigation expenses and assessed attorney's fees to the tune of almost $10,000.
