Meyers invested $850,000 in a land development project. As part of the terms of his investment, the developer was required to repay him if they terminated the contract and a related entity then purcha ... sed the property. The developer did, indeed, terminate the contract, and their sister corporation did purchase it. They refused to refund the money due to Meyers, however. Meyers filed suit, and won on summary judgment. The developer appealed, and the Superior Court affirmed the decision of the Court below, adopting Gawthrop Greenwood's positions as to waiver.
