Definitely not the B-1.
For the E-1/E-2 your country must have an agreement with the USA.

If he filed his Asylum application with while in legal NIV status, then technically he is not out of status until his I-589 is denied. USCIS Asylum...

You first need to find an employer for her. Do not forget that time spent on H-4 counts against the 6 years.

Do not work without employment authorization.
Get your OPT to cover the gap before the H-1B. Otherwise you will have to travel outside.

You may file for divorce. You do not have any obligation to do anything about his legal status.
