Small claims court is probably your best bet if there is only a few thousand dollars worth of damage to the car.

Because your son was not hurt, there are little to no damages. Any negligence case requires someone actually be hurt by the Defendant's conduct.

I have never heard of any bad faith laws that allow you to go after a governmental entity. Generally they are immune.
