OUTCOME: Client plead to wet reckless instead of second time DUI with enhancements
Client stopped for traffic violation. Failed DUI field sobriety tests. Arrested and taken to Orange County CHP station, where they did a forced blood draw, which was against Client's religion. Also ... charged with refusal and because he would not voluntarily provide blood, they added interference with a officer in the performance of his duties. Filed motions to suppress on Freedom of Religion grounds and got blood results suppressed. At pretrial also got the refusal dismissed as the Court found the officers should have given the choice of a urine test since blood was considered "unavailable." The Court on motion also dismissed the interference charge. DA also tried to file this as a second DUI, but after motions, the Court ruled the DA could not sustain the enhancement and it was removed.
OUTCOME: Diverted to Veterans' Court with charges dismissed after successful completion of diversion program.
Client charged with kidnapping, robbery, domestic violence, and possession of incendiary devices.
