Action was brought against the Berks County Recorder of Deeds as a result of delays in the recording of documents, the recording of documents out of order and the imposition of unreasonable conditions ... on the recordation of documents. In October 2006, a mandamus Order was entered changing the manner in which documents were recorded in the Berks County Recorder of Deeds. When the Recorder failed to comply with the Order, the PLTA sought and obtained an Order holding the Recorder in contempt of Court for failing to abide by the Order. The finding of contempt required the Recorder to pay attorney's fees and costs incurred by the PLTA. The relief obtained in this case changed the manner in which documents were recorded in the Berks County Recorder of Deeds and was a major victory for the title industry in that it could more reasonably rely on the state of the recording records in Berks County after this relief was obtained.
