The Plaintiff contends that the vehicle contained substantial defects and was not properly repaired under Ford’s warranty within a reasonable number of attempts. Plaintiff contends that Defendant Ford’s refusal to repurchase the vehicle was in violation of California’s Lemon Law (the Song-Beverly Consumer Warranty Act). Defendant Ford denies that it violated the Song-Beverly Act or that it breached a written warranty. As such, Ford maintains that it was not in violation of California’s Lemon Law and had no legal obligation to repurchase Plaintiff’s vehicle.
