Represented defendants/respondents in matter involving allegations of construction defect. Plaintiff/appellant had brought an action years before, and they lost at trial and on appeal. Plaintiff/appell ... ant brought another suit, based on the same nucleus of facts, but asserting new legal theories. Case was dismissed on res judicata grounds, and the decision was affirmed by the First District. Respondents were able to recover all attorney's fees incurred in litigation.

Construction Defect Litigation. I represented the owner-builders of a custom luxury home in the Hayward Hills who were sued by the purchaser after she allegedly discovered defects to the home. I succes ... sfully argued that my clients could not be held liable as "builders" under the relevant state law - SB800 or the "Right to Repair Act" - and obtained full summary judgment in my client's favor. The plaintiff appealed the decision to the First District.
