Petition for Review before the U.S. Ninth Circuit Court of Appeals: The Immigration Judge denied Petitioner's Cancellation of Removal and Withholding of Removal applications, and ordered him removed b ... ased on a Possession for Sale of Cocaine conviction. She ruled that the conviction was both an Aggravated Felony and a Particular Serious Crime. She did not analyze the facts of the case under the Matter of Y-L- factors in order to determine whether he would be eligible for relief despite the conviction. We argued that the judge should have analyzed the facts under the Matter of Y-L- factors, and therefore the case should be remanded for that purpose. The Ninth Circuit agreed and granted our Petition for Review.
