On July 16, 2015, plaintiff goes into an indoor rock climbing gym with some friends. Plaintiff had not been rock climbing indoors or outdoors prior to July 16, 2015. Plaintiff was bouldering, or what ... is known as free climbing, 11.5 feet above the floor surface. Plaintiff slipped from the climbing wall falling to the ground landing on left his foot first. Plaintiff suffered a fracture of his calcaneus bone necessitating emergency surgery with that required plates and screws to repair the fracture. Plaintiff was able to overcome the defenses of assumption of risk, execution of waivers, and that defendant was not grossly negligent in it ownership and maintenance of its equipment.
