Vigilant Insurance Company v. Lincoln General Insurance Company
N/AOUTCOME: Summary Judgment for Plaintiff
Mr. Barry Root was driving a rental car when he rear-ended another vehicle. He was at the time, covered by his own insurance and and paid for the supplemental liability insurance of the rental car. R ... oot was sued by the driver that he struck, but the supplemental liability insurer refused to pay for the remainder of the settlement amount. The Court granted summary judgment in favor of Plaintiffs finding that as a matter of law, the Rental Car supplemental liability insurance should cover the damages before Mr. Root's personal line of coverage.
